Marset, responsible for the website www.marset-store.com, puts at the disposal of the users the present document, with which it tries to give fulfillment to the obligations arranged in the Law 34/2002, of Services of the Society of the Information and of the Electronic Commerce (LSSI-CE), and in the Royal Legislative Decree 1/2007, of November 16, by which is approved the rewritten text of the General Law for the Defense of the Consumers and Users and other complementary laws (TRLGDCU) as well as to inform to all the users of the web site, with regard to which are the conditions of use of the site.

The purpose of this contract is to regulate the provision of services offered through this website, and specifically, the sale of lamps. Marset Store offers a selection of Marset Iluminación's catalog and its sales service is aimed at individuals acting as consumers/individual customers.

The product offerings on this website are aimed at consumers of our products, understanding consumer as established in Article 3 of Royal Legislative Decree 1/2007 of November 16, 2007, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter TRLGDCU).

For these purposes, natural persons acting for purposes other than their trade, business, trade or profession shall be considered consumers or users. Likewise, legal persons and unincorporated entities acting for non-profit purposes outside a trade or business activity shall also be considered consumers.

Marset Store serves the following European Union member states: Austria, Belgium, Bulgaria, Croatia, Cyprus (south zone), Estonia, France, Germany, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain (excluding the Canary Islands, Ceuta and Melilla), the Czech Republic and Romania.France, Czech Republic, Germany, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia and Spain (excluding the Canary Islands, Ceuta and Melilla).

You will be able to make a purchase from the country of your choice, but we can only ship your order to addresses located in the countries listed above, so users are advised to review the list of destination countries appropriately. When changing the destination country, shipping methods, delivery points and other sales conditions are updated according to the purchase conditions of that destination country. Orders cannot be shipped to military bases or P.O. Boxes.

The articles offered on the Web Page are a selection of products from the complete Marset collection and meet the same quality and warranty requirements as the products offered for sale, if any, in the Marset Iluminación S.A. distribution network.

Each product is accompanied by the following data:

* Marset Store has made an effort to show the colors of the products as close to reality as possible. However, the color that appears on the screen of your device may be subject to variations depending on the quality or typology of the device. In this sense, Marset Store cannot guarantee that the colors that appear on the screen of your device are true to reality.

In addition, the characteristics of the materials used in the manufacture of some of the products may present variations in texture and color due to the artisanal processes involved in their manufacture. These variations will not be considered as quality defects or flaws.

Special offers, promotions or discounts will be valid until the date indicated in the "Temporary offers and promotions" section or while stocks last.

In the same way, Marset Store makes the necessary efforts so that the information contained in the Web Page is complete, truthful and correct. If there is an error in any data, Marset Store will proceed to its rectification.

 

Purchase of Products

a. How to buy Products

To place orders for Products, the User must follow the purchase procedure established on the Website and select "Finalize my order".

Before placing the order, a summary of the order will be presented identifying the product(s) added to the cart, their total price (including shipping and taxes) with each item broken down and the shipping details of the order, so that the customer can confirm the order by clicking on the 'Pay now' button.

Then, Marset will send an email to the User to the address indicated by the User confirming that the Order has been accepted (the "Order Confirmation") as acknowledgement of receipt of the order with a description of the order and including the personal data provided by the User. The contract shall only cover those Products indicated in the Order Confirmation.

The non-receipt of this message may be due to a transient communications problem in the network or a typing error in the email address provided. In both cases, Marset Store recommends the customer to contact Customer Service through hello@marset-store.com.

The purchase process can be done as a guest or under registration, obtaining a User Account, always indicating a valid billing address and payment details. To make the purchase, the customer's personal data will be required, which will be incorporated into our database in order to process the order and, in the case of creating a User Account, will facilitate the realization of new purchases.

Personal data provided by customers will be treated in accordance with the provisions of our Privacy Policy. The customer will be able to access, at any time, to the personal data provided and to the information of the orders placed. Marset Store reminds customers that personal data must be indicated accurately to avoid confusion or incidents in the shipment of the item(s) purchased. In addition, the customer, if expressly requested by him, will receive by email and / or sms commercial communications tailored to your profile.

b. Product Availability

All orders are subject to availability of the Products. In the event that, once sent the Shipping Confirmation, Marset could not have the Product ordered for any reason, will contact the User as soon as possible communicating this circumstance. In such a case, Marset may:

1. offer the User a product with similar characteristics and specifications to the one initially requested, provided that these are in accordance with the User's needs; and/or

2. offer the User to cancel the requested Order by refunding the amount paid for it, within fourteen (14) business days.

c. Refusal to process an Order

Although Marset will do its best to always process all Orders, there may be exceptional circumstances that require it to refuse to process an Order after the Order Confirmation has been sent, and Marset reserves the right to do so at any time, at its sole discretion.

Marset reserves the right to remove any Product from the Web Site at any time and to remove or modify any material or content of the Web Site, not being liable to the User or any third party for the fact of removing any Product from the Web Site, regardless of whether such Product has been sold or not, to remove or modify any material or content of the Web Site.

d. Product Warranty

All the Products contained in the Web Site are original Marset products. All of them have a three (3) year warranty in accordance with the criteria and conditions described in the Royal Legislative Decree, 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

The Products shall be deemed to be in conformity with the Terms of Use provided that they comply with all of the requirements set forth below:

1. Conform to the description provided by Marset and possess the qualities of the Product that Marset has presented to the User in the form of a sample or model.

2. Are suitable for the uses to which Products of the same type are ordinarily put.

3. Are suitable for any special use required by the User when the User has informed Marset, provided that Marset has admitted that the product is suitable for such use.

4. They present the usual quality and performance of a product of the same type that the User may expect, taking into account the nature of the Product.

In the event that it is proven that the Product does not conform to the specifications, Marset will proceed, where appropriate, to repair, replacement, price reduction or termination of the contract being such steps free of charge to the User.

The warranty does not cover displacements, or defects caused by bumps, scratches, misuse or normal wear and tear of materials. Marset is not responsible for damage to the Products that may result from misuse of the same, as well as acts or omissions of the User that do not conform to the specifications of each Product or damage caused by third parties that are not linked to Marset.

Marset takes the greatest care in the presentation and description of the Products. However, the photographs of the Products are presented for illustrative purposes only. To know the precise characteristics of each Product you should check the corresponding descriptive data accompanying each Product.

e. Delivery of the Products

Shipments will not have any additional cost.

Once the Shipping Confirmation has been sent, the Products will be delivered to the address indicated by the User when placing the Order within approximately:

Spain	2 - 3 working days
European Union	3 - 7 working days

 

The risk of the products shall be borne by the customer from the time of delivery. The shipment of the products purchased through the Website will be made through a courier company and will be delivered within a period indicated on the Website according to the selected shipping method and, in any case, within a maximum period of thirty (30) calendar days from the date of receipt of the Confirmation.

Orders may be tracked by means of order tracking communications which will indicate, at any given moment, where the product(s) is (are) located until its (their) final reception.

Marset will choose the most appropriate company to make the shipment according to type and geographic region, who will proceed to the delivery directly to the shipping address you have notified us. It is required that there is someone at that address during working hours and a contact telephone number.

Delivery" or the order shall be deemed to have been "delivered" at the time you, or an authorized third party, acquire physical possession of the products.

Marset does not assume any responsibility when the delivery of the Product does not take place as a consequence of the data provided by the User being false, inaccurate or incomplete or when the delivery cannot take place for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the User or the retention of the Product in Customs.

Transport times may be altered due to extraordinary incidents in the logistics services company/s, periods of high demand, difficulties in the delivery of the goods and/or force majeure; in any case, no delay in delivery with respect to the deadlines indicated shall entitle the user purchaser to claim any compensation whatsoever.

Shipping costs may be changed at any time without prior notice. Such change will be applicable from the moment the modification is included in these Terms and Conditions of Sale. In any case, the shipping costs that appear at the time of placing the order will be valid.

f. Price and payment of the Products

The prices applicable to each Product shall be those published on the Website on the date on which the User places the Order. The prices indicated, with respect to each of the products or services offered on the site, include Value Added Tax (VAT) and shall be understood in Euros (€). The prices applicable to each service, will be those published on the website or those offered in the form of offers and promotions on the website or in banners, commercial communications of the provider, etc..

Although Marset tries to ensure that all prices listed on the Website are correct, errors may occur. In the event that Marset discovers an error in the price of any of the Products ordered by a User, it will inform the User as soon as possible and will give the User the option of reconfirming the Order at the correct price or cancelling it. If Marset fails to contact the User, the Order will be considered cancelled and the User will be refunded in full the amounts paid.

Marset shall not be obliged to supply to the User any Product at the incorrect lower price (even if the Order Confirmation has been sent) if the error in the price is obvious and unequivocal and could have been reasonably recognized by the User as an incorrect price.

Prices may change at any time. However, possible changes will not affect the Products for which Marset has already sent the Shipping Confirmation.

I. Payment Methods

The User may pay by Visa, Visa Electron, Mastercard, or American Express credit or debit card. To minimize the risk of unauthorized access, the User's credit card information will be encrypted. Whether the payment is made by credit or debit card or through PayPal, the charge will be made at the time that Marset sends the Order Confirmation to the User.

The customer may choose, for each online purchase, the payment method that is most convenient according to the terms and conditions offered. For the purpose and effect that Marset Store can make the appropriate arrangements, you must notify as soon as possible of any undue or fraudulent charge in the payment method used for the purchase on which the infringement has occurred.

Failure to notify Marset within 24 hours will exonerate Marset from any responsibility for the refund.

II. Value Added Tax (VAT)

The applicable VAT rate will be that legally in force at any given time depending on the specific product in question.

III. Billing

The customer expressly consents to Marset issuing a simplified invoice. To obtain the invoice, please request it by writing an e-mail to hello@marset-store.com and indicating the order number. 

IV. Purchase limit

Purchases of more than 3.000€ will not be allowed. Customers who are interested in making purchases in excess of this amount or amount for other purposes such as resale should contact Customer Service where they will be informed about the various options for making the desired purchase.

 

Product returns and refunds.

a. Right of Withdrawal

In accordance with applicable regulations, if the User is contracting as a consumer, they may withdraw from the contract (except in cases established by law) and freely return the Products delivered at any time within a period of fourteen (14) calendar days from the delivery date thereof (the "Withdrawal Period"). The aforementioned right of withdrawal will not be valid for those products that have been made according to the specifications made by the buyer or clearly personalized.

The communication and management of said withdrawal must be carried out within the aforementioned period through the Returns Portal or by writing an email to hello@marset-store.com in accordance with the Conditions and Instructions detailed in the Returns Policy.

No refund will be made if the product has been used beyond mere opening, if the products are not in the same conditions as they were delivered, or if they have suffered any damage, so the customer must be careful with the product(s) while they are in their possession. Likewise, the returned items must include all their original packaging, instructions, and any other accompanying documents.

Once the relevant inspection of the returned Product has been carried out to ensure compliance with the requirements established in the following section c), Marset will refund the User the corresponding amount, minus the return costs, in the same payment method used in the purchase and within a maximum period of 14 days.

Marset will not refund the amount or make any merchandise reshipment until the receipt and condition of the packaging and accessories of the returned item have been verified.

After the Withdrawal Period has elapsed, no returns of Products will be accepted. Only exchanges for those Products that may have been defective will be accepted in accordance with the following section.

b. Return or Replacement of Defective Products

In the event that the User considers that the Product does not comply with the specifications established for said Product, they must contact Marset immediately via email at the contact address hello@marset-store.com providing the Product details, as well as informing of the defect it has and whether they opt for the return or replacement with an identical Product.

The User may return the Products through the Returns Portal or by their own means, as detailed in our Returns Policy. Once the relevant inspection of the returned Product has been carried out, Marset will send an email to the User within a reasonable period informing them whether the return or replacement of the Product is appropriate.

In the event of a return, Marset will fully refund the User the price of the Product. If the User has opted for the replacement, Marset will bear the shipping costs.

c. Common Provisions for Returns and Refunds

The User must meet the following requirements to exercise the right of withdrawal, as well as to make returns and replacements of Products:

1. To arrange the return of the Product, the User must first access the Returns Portal or contact Marset by sending an email to the contact address hello@marset-store.com;
2. The User may prove the exercise of the right of withdrawal in any form permitted by law;

III. The Product must be returned in the same conditions as it was received. Marset will not refund any amount if the Product has suffered any damage, so the User must be careful with the Product while it is in their possession;IV. The refund will be made in the same payment method that the User used to pay for the Product and within 14 days following the verification of the returned merchandise.

 

Law and Jurisdiction

These Terms and Conditions and any relationship between you and Marset shall be governed by Spanish law.

For any dispute between you and Marset arising out of the existence or content of these Terms or your visit to the website, both parties submit to the non-exclusive jurisdiction of the courts of the country.
